Arizona court allows voter pamphlet to use term ‘unborn human being’ referring to fetus


The Arizona Supreme Court has ruled that an official informational pamphlet for Arizona voters can refer to a fetus as an “unborn human being” as they prepare to decide in November whether to guarantee a constitutional right to an abortion. The proposed amendment seeks to allow abortions until a fetus could survive outside the womb, typically around 24 weeks, with exceptions to save the pregnant individual’s life or protect their physical or mental health. The court’s decision was a victory for Republican lawmakers but drew criticism from abortion rights advocates who argue that the language used is biased and politically charged.

The voter guide, produced by the Arizona Secretary of State, contains information on candidates and ballot measures to help inform voters. However, it is unclear if the language used in the pamphlet will appear on the ballot itself. The coalition supporting the ballot measure had submitted far more signatures than required to put the question before voters.

Abortion rights have become a central message for Democrats following the overturn of Roe v Wade and are a key part of their strategy in this year’s elections. Arizona, a major battleground state, is expected to see increased turnout among Democratic voters due to enthusiasm for the ballot measure.

In recent years, several states have voted on abortion-related ballot measures, with some Republican strongholds even passing measures to preserve abortion rights. The decision in Arizona comes after the state’s near-total abortion ban from 1864 was allowed to take effect, leading to national outrage and ultimately resulting in the ban’s repeal by a bipartisan group of legislators.
