West Virginia Supreme Court Reinstates Classification System for High School Sports


The West Virginia Supreme Court of Appeals has reinstated previous high school football classifications after injunctions postponed playoffs. The court ruled that the WVSSAC had the authority to reclassify schools and overturned decisions made by lower courts that interfered with the classification system.

In response to similar cases involving class A high school volleyball, the Supreme Court has granted motions for expedited relief. Playoffs for class A volleyball were postponed pending a decision by the court after conflicting rulings from circuit courts.

One case involved Tyler Consolidated High School being moved from class A to class AA, while East Hardy High School sought to prohibit Tyler Consolidated from participating in the class A volleyball tournament. Attorneys for the WVSSAC filed writs of prohibition with the Supreme Court seeking to lift the preliminary injunction and provide guidance on which lower court order to follow.

The Supreme Court has stated that lower courts overstepped their authority and substituted their judgment for that of the WVSSAC in these classification cases involving high school sports. The court has set deadlines for responses from attorneys involved in the cases and is actively working to resolve the issues surrounding high school sports classifications.
