Attorney Elgine McArdle has filed a motion to have a judge dismiss a first-degree murder charge against Fairmont Pagan’s Motorcycle Club member Ryan Ray Lane. This comes after fellow club member Austin Mullins confessed in writing to the shooting of Henry Silver. Lane was one of six men charged in the shooting that took place on September 9, 2022.
The circumstances of Silver’s death revolve around a love affair between Silver and another club member’s girlfriend. Prosecutors allege that Lane was involved in planning the shooting, but McArdle claims that Lane was not present during the incident and had no knowledge of it.
Mullins, who has confessed to the shooting, stated in his letters to Lane that Lane is innocent and that the state was aware of this. McArdle argues that Lane’s due process rights were violated during the proceedings, including being denied the right to attend a preliminary hearing. McArdle believes that the prosecutor’s failure to disclose exculpatory evidence and withholding information from the grand jury warrant a dismissal of the case.
The filing also references the recent conviction of another club member, John Lee Wolfe, claiming that Wolfe’s trial was lacking in evidence linking Lane to the shooting. Mullins advises Lane to be cautious and not trust everyone within the club. McArdle is seeking justice for Lane and urging the judge to dismiss the case based on constitutional violations and the prosecutor’s failure to disclose vital information.
