West Virginia Senate Judiciary Committee discusses concerns over AI imagery in election usage | News, Sports, Jobs

In a recent hearing before the state Senate Judiciary Committee, David Cook, general counsel for the Secretary of State’s Office, testified about SB 484, a bill aimed at regulating the use of artificial intelligence and synthetic media in elections. The bill seeks to prevent the distribution of deceptive synthetic media designed to harm candidates or influence election results within 90 days of an election, unless a disclaimer is included. The proposed law also includes exceptions to protect First Amendment rights.
Violators of the legislation could face misdemeanor charges and fines up to $1,000 along with potential civil penalties. Complaints about the use of AI and synthetic media would be made to the State Election Commission. The bill was amended before being recommended for passage by the committee, sending it to the full Senate for consideration. Cook emphasized that the legislation is designed to protect candidates from attacks via AI while also respecting individuals’ First Amendment rights.
