Haitian immigrants take legal action to halt Trump administration’s plan to end temporary protection

Three organizations have filed a lawsuit to block the Trump administration’s attempt to end Temporary Protected Status (TPS) for individuals from Haiti and Venezuela living in the U.S. The administration rescinded the TPS extension that was granted under President Biden, requiring Haitians to return by August 3 and Venezuelans by April 2. The lawsuit, filed by Lawyers for Civil Rights on behalf of Haitians in the U.S. under TPS, challenges the administration’s decision. The lawsuit argues that TPS is a critical lifeline for immigrants who have fled violence, upheaval, and disasters in their home countries. The Boston area is home to a large Haitian community, and a Haitian American in Boston expressed disagreement with Trump’s attempt to deport individuals under TPS before its expiration in 2026.

The lawsuit, filed by three immigrant advocacy organizations and four affected individuals, accuses Trump of racial bias and lacking authority to revoke an extension that has already been granted. The complaint references Trump’s controversial remarks about Haiti and African nations, as well as unfounded claims he made about Haitian immigrants. Two plaintiffs, who are real estate broker, business owner, and nurse, made Massachusetts their home in 2018, are challenging the administration’s directive. The community is anxious about the potential loss of legal status, possible deportation to unstable conditions in Haiti, and difficulty in finding alternative legal pathways in the U.S. The lawsuit aims to prevent the premature deportation of individuals under TPS and ensure that their legal status is upheld until its expiration in 2026.
