West Virginia Senate approves food dye ban; legislation sent back to House for consideration


The West Virginia Senate has passed House Bill 2354, which aims to ban certain food dyes from being sold in grocery stores and school meals. The bill, which was originally passed by the House of Delegates, faced amendments in the Senate before being passed in a 31-2 vote. If signed into law by Governor Patrick Morrisey, the ban would come into effect in schools in August of this year, ahead of the FDA’s ban on Red Dye 3 in 2027. However, the National Confectioners Association has expressed opposition to the bill, arguing that it would make food more expensive and less accessible for West Virginians. The association believes that the FDA should be the primary authority in regulating food safety and that there should be a consistent, science-based national regulatory framework. The bill will now return to the House of Delegates for a vote on whether to concur with the Senate’s amendments before it can be sent to the governor for approval. If passed, West Virginia would join a growing number of states taking action to regulate food additives and promote public health.
