Judge Denies Bond for Pagans Motorcycle Club President in 2022 Murder Case
FAIRMONT, WV — In a significant development regarding the 2022 murder case of Henry Silver, Marion County Circuit Court Judge Patrick Wilson has denied bond to Ryan Lane, the president of the Pagan’s Motorcycle Club. The prosecution alleges that Lane sanctioned Silver’s murder following Silver’s alleged involvement in an affair with a member’s friend.
Lane’s attorney, Elgine McArdle, argued for his release based on a previous trial involving one of Lane’s co-defendants, Austin Mullins, who confessed to the murder but was convicted of second-degree murder, suggesting that there was no premeditated intent. McArdle emphasized a logical inconsistency, questioning how Lane could be implicated in a conspiracy for first-degree murder when Mullins was found guilty of the lesser charge.
Notably, McArdle asserted that Lane was not present at the crime scene, which was acknowledged by the prosecution, and contended that mere gang affiliation is not illegal. She criticized the prosecution’s approach, claiming it relied on prejudiced views of the Pagan’s Motorcycle Club as inherently violent, stating, "The prosecution’s whole theory of the case is Pagan’s are bad, they don’t belong in Marion County, convict them."
Marion County Assistant Prosecuting Attorney Sean Murphy countered that the motion for bond has been repeatedly denied, noting that the case’s basis had not changed. Judge Wilson referenced previous rulings from Judges David Janes and Matthew Delligatti, who had also denied bond motions, reiterating that two grand juries found sufficient probable cause to indict Lane for Silver’s murder.
With Lane’s trial set to commence in July, the court has been cautioned by the evidence presented, which may establish a link to the murder beyond a reasonable doubt.
